Article 1: Scope of Application

These General Terms and Conditions of Sale are agreed between, on the one hand, TERROIRS&CO, and on the other hand, all persons, whether natural or legal, registered on the website www.leclubterroirsandco.com and wishing to order one or more products offered by the website, hereinafter referred to as ‘the customer’.

These General Terms and Conditions of Sale apply to all orders placed via the website www.leclubterroirsandco.com and to all orders received by post or telephone.

Unless expressly accepted in writing by TERROIRS&CO, no special conditions may take precedence over these General Terms and Conditions of Sale.

By confirming the order, the customer acknowledges that they have read these General Terms and Conditions of Sale and accept their terms. Should any provision be missing, it shall be deemed to be governed by the distance selling regulations of the place where the company is based.

Article 2: Prices

The prices shown are in euros and include all taxes. They include, in particular, applicable VAT, excise duties and any other applicable taxes. The prices displayed are net and exclude shipping and delivery charges. Shipping charges vary depending on the delivery area and the number of products ordered.

TERROIRS&CO reserves the right to amend its prices and delivery charges at any time; however, products will be invoiced on the basis of the rates in force at the time the order is placed and subject to availability.

Article 3: Order

TERROIRS&CO undertakes to accept orders in accordance with these General Terms and Conditions of Sale and subject to stock availability. TERROIRS&CO will fulfil each order through one or more deliveries of the products ordered, depending on product availability at the time of ordering.

No order will be processed until payment has been accepted.

TERROIRS&CO reserves the right to cancel any orders that are non-compliant or suspicious, as well as those from a customer with whom there is a dispute regarding payment for a previous order.

By confirming the order, the customer declares that they have read and accept these General Terms and Conditions of Sale. Confirmation of your order therefore constitutes acceptance of these General Terms and Conditions of Sale

Article 4: Availability and validity of offers

The products offered are subject to availability. In the event that one or more products are unavailable after the order has been confirmed, TERROIRS&CO undertakes to inform the customer by email or telephone of the partial or total cancellation of their order.

In the event that payment has already been debited from the customer’s bank account, TERROIRS&CO will proceed as soon as possible to refund the undeliverable product(s) by crediting the credit card used to pay for the order.

Article 5: Delivery

The order is delivered to the delivery address chosen by the customer. Delivery charges are automatically calculated on our website based on the quantity of items purchased, the geographical area and the chosen delivery method (see the Delivery section for further details).

The customer is required to check their parcels carefully upon delivery in order to immediately raise any objections with the carrier or at the collection point.

Article 7: Payment

Payment for goods is made at the time of ordering and exclusively by credit card (Carte Bleue, Visa, MasterCard). By confirming their order on the website www.leclubterroirsandco.com, the customer is connected directly to our bank.

The customer warrants that they are fully authorised to use the credit card provided and that this credit card has sufficient funds to cover the order amount.

Article 8: Guarantee

If the customer is not satisfied with the products ordered, they have a 15-day cooling-off period from receipt of their order to return the goods in their original packaging.

Return costs are the customer’s responsibility, and the price paid for the returned goods will be refunded to the customer by credit card or cheque within one week of receipt of the return.

Article 9: Retention of title

In accordance with the law of 1 May 1980, products delivered to the customer are sold subject to retention of title. Transfer of ownership is conditional upon full payment of the price of the products by the customer, on the due date agreed between the parties.

In the event of non-payment of the full price of the goods by the agreed due date, TERROIRS&CO may reclaim ownership of the products at the customer’s expense and risk.

Article 10: Intellectual Property

All elements of the TERROIRS&CO website (text, photos, visuals and audio) are the exclusive property of TERROIRS&CO or its partner domains.

The language of this contract is French. All clauses of these General Terms and Conditions of Sale, all transactions and purchases made via the TERROIRS&CO website, as well as by post and telephone, are governed by French law.

Any dispute that cannot be resolved amicably shall fall within the jurisdiction of the Courts of Créteil.

Article 14: Protection of minors

In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under the age of 18 is prohibited. The member undertakes to be at least 18 years of age when placing their order.

Article 15: Acceptance by the buyer

These General Terms and Conditions of Sale, as well as the prices of the products sold on the website, are expressly accepted by the customer, who declares and acknowledges that they have read and understood them; consequently, the customer waives the right to rely on any conflicting document, in particular their own general terms and conditions of purchase.
